1. Agreement to Terms

By accessing or using Speedflow ("Service," "we," "us," or "our") at speedflow.cc, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Speedflow is a web-based platform that analyzes Webflow websites and provides recommendations to improve website loading speed and performance. The Service includes:

  • Website performance analysis
  • Speed optimization recommendations
  • Technical improvement suggestions
  • User dashboard and account management

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account by providing:

  • Valid email address
  • Secure password

You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Security

You agree to:

  • Use a strong, unique password
  • Notify us immediately of any unauthorized access
  • Not share your account with others
  • Be responsible for all activities under your account

We are not liable for any loss or damage from your failure to maintain account security.

4.3 Account Termination

We reserve the right to suspend or terminate your account if you:

  • Engage in fraudulent activity
  • Abuse the Service or harm other users

5. Subscription Plans and Pricing

5.1 Available Plans

Free Plan: $0 USD

  • Limited features and usage

Monthly Plan: $19 USD per month

  • Full access to all features
  • Billed monthly

Yearly Plan: $182 USD per year

  • Full access to all features
  • Billed annually (equivalent to ~$15.17/month)

5.2 Payment Terms

  • All prices are in United States Dollars (USD)
  • Payments are processed securely through Paddle
  • All fees are non-refundable except as stated in our Refund Policy
  • You authorize us to charge your payment method for all fees incurred

5.3 Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel before the renewal date. You will be charged the then-current price for your subscription plan.

5.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until that date.

5.5 Price Changes

We reserve the right to modify our pricing. We will provide at least 30 days' notice of any price increases for existing subscribers. Price changes will take effect at your next renewal date.

6. Acceptable Use

6.1 Permitted Use

You may use the Service only for:

  • Analyzing websites you own or have permission to analyze
  • Legitimate business purposes
  • Personal, non-commercial use (Free Plan)

6.2 Prohibited Activities

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated tools (bots, scrapers) without permission
  • Resell or redistribute the Service without authorization
  • Overload or interfere with the Service's functionality
  • Impersonate others or provide false information
  • Analyze websites without proper authorization
  • Use the Service for illegal or unethical purposes

6.3 Enforcement

Violation of these terms may result in immediate suspension or termination of your account without refund.

7. Intellectual Property

7.1 Our Rights

The Service, including all content, features, functionality, software, code, algorithms, design, graphics, and trademarks, is owned by Speedflow and protected by international copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business use, subject to these Terms.

7.3 Your Content

You retain ownership of any website URLs and data you submit to the Service. By using the Service, you grant us a limited license to access and analyze the submitted websites solely to provide the Service to you.

7.4 Analysis Results

The analysis results and recommendations generated by our Service are provided to you for your use. We retain the right to use aggregated, anonymized data from analyses to improve our Service.

8. Disclaimer of Warranties

8.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of recommendations

8.2 No Guarantee of Results

We do not guarantee that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The recommendations will improve your website performance
  • Any errors will be corrected
  • The Service will be compatible with all systems

8.3 Recommendation Disclaimer

9. Limitation of Liability

9.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEEDFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Loss of business opportunities
  • Website downtime or performance issues
  • Costs of substitute services
  • Any damages resulting from implementing our recommendations

9.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

9.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Speedflow and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Violation of these Terms
  • Infringement of any third-party rights
  • Your website content or any illegal activities

The Service may contain links to third-party websites or services. We are not responsible for:

  • The content or practices of third-party sites
  • Any transactions with third parties
  • Privacy policies of external services

11.2 Payment Processor

Payments are processed by Paddle. Your use of Paddle's services is subject to their terms and privacy policy. We are not responsible for Paddle's actions or any payment processing issues.

12. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Modifications to Service

We reserve the right to:

  • Modify or discontinue the Service (or any part thereof) at any time
  • Change features, functionality, or pricing
  • Impose usage limits or restrictions

We will provide reasonable notice of material changes when possible, but we are not obligated to do so for minor updates.

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

  • Canceling your subscription through account settings

  • Ceasing to use the Service

14.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Breach these Terms
  • Engage in prohibited activities
  • Fail to pay fees when due
  • Request account deletion

14.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and data
  • You remain liable for any fees incurred before termination
  • Provisions that should survive (liability, indemnification, etc.) remain in effect

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing any formal claim, you agree to contact us at info@speedflow.cc to attempt to resolve the dispute informally for at least 30 days.

15.3 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Krakow, Poland.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Speedflow regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or internet/utility failures.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Sending an email notification (for significant changes)
